1. Service Overview
Welcome to KamiClaw (the "Platform"), operated by Kami Vision, Inc. ("we," "us," or "Kami Vision"). KamiClaw is a Video AI security detection platform built on OpenClaw, providing API-based Skills including but not limited to person detection, package detection, smoke detection, vehicle detection, and abnormal behavior monitoring (collectively, the "Services").
By accessing or using the Platform, you agree to be bound by these Terms of Service (the "Agreement"). If you are accepting this Agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity. If you do not agree to these terms, do not use the Platform.
2. Eligibility and Account Registration
Only individuals aged 18 or older may register for an account on the Platform. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this Agreement.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and API Keys, and for all activities that occur under your account. You must notify us immediately at kamiclaw@kamivision.com if you suspect any unauthorized use of your account.
You may not transfer or share your account with any third party. Kami Vision reserves the right to suspend or terminate accounts that contain inaccurate information or are involved in improper or illegal activities.
3. Service Usage
When using the Platform, you agree to:
- Comply with all applicable laws and regulations
- Not use the Services for any unlawful, harmful, or infringing purpose
- Not attempt unauthorized access to the Platform's systems or data
- Not interfere with or disrupt the normal operation of the Platform
- Not exceed the usage limits of your subscription plan
- Not reverse engineer, decompile, or disassemble any part of the API or Services
- Not use the Services to process content that violates any person's privacy rights
- Comply with all applicable recording and surveillance laws when using video detection Skills
You are solely responsible for all content submitted to the Platform through the API, including any video data processed by the detection Skills. You must ensure that you have obtained all necessary consents and permissions for any data you submit.
4. Credits and Billing
The Platform operates on a Credits-based billing model. Each API call consumes Credits based on the type of Skill used and the volume of data processed. Different subscription plans provide different Credit allocations and usage limits.
All payments are processed through Stripe. By providing payment information, you authorize us to charge your designated payment method for applicable fees. You are responsible for keeping your payment information current. If a charge is declined, we may suspend access to the Services until payment is resolved.
Purchased Credits are non-refundable unless otherwise required by applicable law. Unused Credits remain available within your account for the duration of your active subscription period. Credits do not carry over between subscription periods unless explicitly stated in your plan terms.
5. Subscriptions
The Platform offers multiple subscription plans, including a free tier and paid plans. Paid plans may be billed on a monthly or annual basis. Subscription fees are charged in advance at the beginning of each billing cycle.
Auto-renewing subscriptions will automatically charge your payment method at the start of each new billing period. You may cancel auto-renewal at any time through your dashboard. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that time.
Kami Vision reserves the right to modify subscription pricing with prior written notice via email. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
6. API Usage and Rate Limits
Access to the Platform's detection Skills is provided through RESTful APIs. Each subscription plan includes specific rate limits and quotas. You agree not to exceed these limits or attempt to circumvent rate-limiting mechanisms.
API Keys are confidential and must not be shared publicly or embedded in client-side code. You are responsible for all API calls made using your keys. Kami Vision may throttle or suspend API access if abnormal usage patterns are detected or if usage threatens the stability of the Platform.
7. Service Availability
Kami Vision will use commercially reasonable efforts to maintain the availability of the Platform. However, the Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. Scheduled maintenance, system upgrades, or force majeure events may result in temporary service interruptions.
Kami Vision may modify, update, or discontinue any feature of the Platform at any time. We will provide reasonable notice for material changes that affect your use of the Services.
8. Intellectual Property
All content, technology, trademarks, and intellectual property associated with the Platform are owned by Kami Vision or its licensors and are protected by applicable intellectual property laws. Subject to this Agreement, Kami Vision grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for their intended purpose.
You may not copy, modify, distribute, sell, or create derivative works based on the Platform's technology, APIs, or documentation without prior written consent from Kami Vision. You retain ownership of any data you submit to the Platform, subject to the license granted to us to process that data for the purpose of providing the Services.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAMI VISION AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL KAMI VISION'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION IS CUMULATIVE AND SHALL NOT BE INCREASED BY MULTIPLE CLAIMS.
The Services are not designed or intended for use in life-critical or safety-critical applications. You assume all risk associated with reliance on detection results provided by the Platform.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. KAMI VISION DOES NOT WARRANT THAT THE DETECTION RESULTS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Platform, you consent to the practices described in the Privacy Policy.
You are responsible for ensuring that any video data or other content you submit to the Platform complies with applicable privacy and data protection laws, including obtaining necessary consents from individuals whose data may be processed.
12. Termination
Either party may terminate this Agreement at any time. You may terminate by closing your account through the dashboard or by contacting us at kamiclaw@kamivision.com. Kami Vision may terminate or suspend your account immediately if you breach this Agreement, engage in fraudulent activity, or if required by law.
Upon termination, your access to the Platform will cease and any remaining Credits will be forfeited. Kami Vision will not refund any prepaid fees following termination. Sections relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.
13. Indemnification
You agree to indemnify, defend, and hold harmless Kami Vision and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of this Agreement, or your violation of any rights of a third party.
14. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved through binding arbitration administered by JAMS in Santa Clara County, California, unless eligible for small claims court.
You agree to pursue disputes only on an individual basis and waive any right to participate in class actions, consolidated actions, or representative actions. You consent to the personal jurisdiction of the federal and state courts located in Santa Clara County, California.
15. Changes to These Terms
Kami Vision reserves the right to modify this Agreement at any time. Updated terms will be posted on this page with a revised "Last Updated" date. We may also notify you of material changes via email. Your continued use of the Platform after changes are posted constitutes acceptance of the revised terms.
